Are you able to keep a sprint smartphone after its deactivated?

my phone is broken and my uncle(who also has sprint) is getting a new phone,the one that he has just has little problems every know and then but he doesnt want to deal with them if he has a smart phone. so i was wondering if they let him keep the phone once its deactivated
