What is the punishment for credit card fraud in Virginia?

I am 49 yr old male, started to build credit for my uncle back in 2006 (with his verbal permission of course) He declared Bankruptcy in VA back in 2000 and now lives outside of USA Since 2006 I have worked with his newly acquired cards and made purchases and made on time payments until December of 2010 when I lost my job and was not able to make remaining unpaid balance on 2 cards totaling $15,000 payments. I explained my situation to my uncle and he said he has no choice other than he get an attorney and report the card uses as fraudulent and see what happens. Now after 5 month above 2 cards (same bank name) have sent me a letter stating the accounts are under investigation for fraudulent activity and information gathered to date indicates I may be resposible for this activity. What are my options and what the penalty may be?
